UMATILLA COUNTY – The case involving the officer-involved shooting of a suspect near Gib Olinger Elementary School in Milton-Freewater ended earlier this month with a guilty verdict. Daniel Soto Madrigal, who was 30 when the crime was committed in September 2024, has been sentenced to 59 months in prison.
“We took this case to trial the first of February and the individual was convicted of resisting arrest as well as the assault of a public safety officer, and an outstanding felony warrant for absconding from his probation,” Umatilla District Attorney Dan Primus said.
Craig Robinson was the only Milton-Freewater police officer on duty when he answered a call on Sept. 24, 2024, of a man who had entered a local house without permission. The reporting party told dispatch that the man had been witnessed hanging around the area for several days. The Milton-Freewater Police Department had received complaints from other citizens that the man had been hanging around the elementary school for several days.
Because there was a felony warrant for his arrest, the officer first trespassed Soto Madrigal from the area and then attempted to take him into custody. The Oregon State Police said the suspect resisted arrest and a use-of-force incident unfolded which culminated in the arresting officer discharging his firearm. OSP led the investigation into the officer-involved shooting.
Soto Madrigal was arrested and transported to an area hospital where he recovered from his gunshot wound. The officer also received medical treatment.
“He resisted the officer and he assaulted the officer,” Primus said. “To me this was a brutal assault. The officer was taking some pretty heavy strikes.”
While there was no body camera footage of the incident, it was in the school parking lot so surveillance video from multiple angles was available as was a video taken by an eyewitness on a cell phone.
