Man sentenced to prison following guilty please in Harney County burglary case

HARNEY COUNTY-A man was sentenced to prison on Thursday, Sept. 24, after pleading guilty to felony burglary charges in Harney County Circuit Court.
Jacob Dale Berry, 26, appeared in custody before Circuit Court Judge Locke A. Williams, where he entered guilty pleas to two separate property crimes stemming from incidents earlier this year.
Under a plea agreement, Berry was convicted of:
- Count 4: First-Degree Burglary (Class A Felony), committed between Jan. 12 and Jan. 19, 2026.
- Count 12: Second-Degree Burglary (Class C Felony), committed on or about Jan. 6, 2026.
Judge Williams sentenced Berry to 24 months in the custody of the Oregon Department of Corrections on the first-degree burglary charge, along with 12 months of post-prison supervision.
For the second-degree burglary charge, Berry received a 20-month sentence. The court ordered eight months of that term to run concurrently with the first count, with the remaining 12 months to run consecutively. In total, Berry faces an effective prison term of 36 months, with credit allowed for time already served.
Both sentences were imposed under Oregon Revised Statute 137.717, which applies enhanced sentencing guidelines to repeat property offenders.
As part of the disposition, 14 additional charges against Berry—including counts of unauthorized use of a vehicle, first-degree theft, criminal trespass, criminal mischief, and unlawful possession of methamphetamine—were dismissed by the state.
Berry knowingly waived his right to a two-day waiting period prior to sentencing. He was represented in court by defense attorney Kyra Kay Rohner, while the State of Oregon was represented by Deputy District Attorney Ryan Patrick Hughes.
Berry was remanded to the custody of the Harney County Sheriff’s Office for transport to the Oregon Department of Corrections.
