BREAKING NEWS: State court steps into Measure 114 challenges

HARNEY COUNTY – While four lawsuits challenging the constitutionality of Oregon’s new gun control measure are being heard in U.S. District Court in Portland, a fifth suit has been filed in Harney County Circuit Court. Unlike with the federal judge, Harney County Judge Robert Raschio has granted a 10-day temporary restraining order against the entirety of Ballot Measure 114.

Within hours of the decision announced early this morning (Tuesday) by Judge Karin Immergut, Raschio’s decision means that the new law can’t be enforced as scheduled on Friday. Raschio ruled that the plaintiffs in this fifth suit would be deprived of their right to bear arms by being unable to legally purchase a firearm or use a magazine that can hold more than 10 rounds of ammunition.

A hearing has been set for Dec. 13 at 9 a.m. in Harney County Circuit Court. At that time those suing the state will request a longer-lasting halt to Measure 114 than the 10-day restraining order affords. The suit is brought by Gun Owners of America, Inc., Gun Owners Foundation, Joseph Arnold, and Cliff Asmussen. The defendants are Gov. Kate Brown, Attorney General Ellen Rosenblum, and Oregon State Police Superintendent Terri Davie in their official capacities.
