Daniel Breshears Sentenced to Time in DOC for Exposing/Fondling Himself

LA GRANDE — Daniel Breshears will spend 28 months in the Oregon Department of Corrections (DOC) and an additional 180 days in the Union County Correctional Facility. That was the sentence handed down by Judge Thomas Powers this week.

The sentence is related to an incident on October 31, 2022, when Breshears entered Blue Mountain Laundry in La Grande, exposed his genitals to a three-year-old child and began fondling himself.

This is not the first time that Breshears has been convicted of a crime of this nature. In 2014 Breshears was sentenced to 70 months with DOC on charges of Using a Child in Display of Sexually Explicit Conduct and Endangering the Welfare of a Minor. That offense involved a female between the age of 5-7 years old according to information provided during sentencing. 


Ryan Browne with Parole and Probation spoke about Breshears’s sexual history and his post-prison supervision since his release, noting that his deviance has grown, stating that the incident at the laundromat involved Breshears crossing gender lines as well as stranger/non-stranger lines. The incident at the laundromat involved a male that was unknown to Breshears, whereas the previous conviction involved a victim known to Breshears. These factors “significantly increase Breshears’s risk to the community,” said Browne.

During the sentencing it was also disclosed that Breshears was given every opportunity for treatment and even then, the incident that took place on October 31, 2022, was mere days after Breshears “graduated” from post-prison treatment. 

Union County District Attorney Kelsie McDaniel expressed that the child’s mother has experienced “mom guilt” wondering what she could have done differently to avoid this situation from happening. It was however made clear by Judge Powers that based on video evidence and other facts presented in court, this was a pre-meditated and very brazen act.

Judge Powers detailed the events of that day as presented in video surveillance footage that clearly shows Breshears entering the laundromat, without laundry in his possession, with his pants unzipped with is genitals out, fondling himself. Breshears did this once the child’s mother, who was shown to have been keeping a diligent eye on the child, bent over to attend to laundry. Breshears reportedly continued with this behavior in front of the child and others in the laundromat for several minutes before leaving the area and entering a nearby business. It is believed that this was in an effort to create an alibi.    

McDaniel also mentioned the change in behavior the child has had since this incident, noting that the child often has concerns in public and asks if someone is a “bad stranger.”

The family of the child chose not to make a statement during the sentencing.

Judge Powers handed down the following sentence on a total of three counts.

**Note that the presumptive sentence was 14 months, so, the sentence the District Attorney asked for and Judge Powers ordered was more than double in total**

Count 1- Attempted Sexual Abuse in the First Degree.

            Sentenced to 28 months in the Oregon DOC with three years of post-prison supervision.

Count 2- Endangering the Welfare of a Minor

Sentenced to 180 days in the Union County Correctional Facility to be served consecutive to count 1.

Count 3 – Public Indecency

Sentenced to 180 days in the Union County Correction Facility.  To be served concurrent to but still consecutive to count 1.
