Appeal filed on gun control law

UMATILLA COUNTY – Umatilla County Sheriff Terry Rowan says it could take two to three years before the federal suit against Ballot Measure 114 is decided. Federal Judge Karin Immergut ruled that the gun control ballot measure is constitutional. Rowan, a named plaintiff in the challenge, said the next step will be to present the case to the Ninth Circuit Court of Appeals.

“We all know how liberal the ninth circuit is,” he said. “They’ll likely uphold the federal judge’s ruling on it. Then, the plan ultimately be to get it before the Supreme Court.”

The case brought by the Oregon Firearms Federation and several individuals including Rowan challenges that the gun control law violates the U.S. Constitution.

Another lawsuit is going on in Harney County that challenges it as a violation of Oregon’s Constitution. The trial for that case begins in September. The Harney County judge has placed a hold on enforcing the law until the challenge is settled.
