Amazon files complaint with PUC, alleging Pacific Power has not met its obligations

SALEM – Amazon Data Services (ADS) has filed a complaint with the Public Utility Commission of Oregon (PUC) against PacifiCorp, doing business as Pacific Power, alleging the utility company failed to fulfill its obligations in providing electric service to Amazon’s data center campuses located within PacifiCorp’s exclusive service territory in Oregon.
The complaint, filed with the PUC on Oct. 30, claims PacifiCorp delivered less power than promised to ADS’s first data center campus, known as Specialized, and delivered no power to the second campus, known as Litespeed. It also accuses PacifiCorp of refusing to complete its own standard contracting process for the third and fourth data center campuses, known as Pivot and Gray.
ADS also alleges PacifiCorp demanded that ADS pay 32.6 percent “tax gross-up” based up a purported internal change in PacifiCorp’s policy that occurred years after the Specialized and Litespeed agreements.
All of Amazon’s data center campuses in Oregon are located in Morrow and Umatilla Counties.
“ADS sited the Data Center Campuses within PacifiCorp’s exclusive service territory in reliance on PacifiCorp’s contractual agreements to serve the Data Center Campuses,” alleges ADS in the complaint. “However, after more than four years—during which time ADS has invested over [Redacted] to develop the Data Center Campuses—PacifiCorp has not met its contractual or statutory requirements for any of the Data Center Campuses.”
ADS contends that PacifiCorp’s actions not only breach its contracts with ADS but also breach its obligations as a public utility with an exclusive service territory.
ADS is asking the PUC to either compel PacifiCorp to provide the promised power in accordance with its statutory and contractual obligations, or to remove the data center campuses from PacifiCorp’s exclusive service territory.
PacifiCorp’s deadline to file a motion against the complaint is currently set for Nov. 10, while an answer to the complaint is due Nove 19. PacifiCorp has since filed requests for extensions: 30 days to file an answer and 39 days to file a motion.
The PUC’s next public meeting is Nov. 13, but nothing on the published agenda mentions this complaint.
