SALEM – The Oregon Supreme Court has denied a request from the state Department of Justice to review Harney County Circuit Court Judge Robert Raschio’s temporary restraining order over enforcing Ballot Measure 114. The court also ruled that Raschio’s order will stand.
The justices gave no reason for their decision. Raschio issued a 10-day restraining order and has scheduled a hearing on Dec. 13 to consider extending it further. The controversial gun control measure, approved by a narrow margin by voters in November, was to have gone into effect today.
Raschio’s order came as a result of a fifth suit brought questioning the measure’s constitutionality. Four other lawsuits were being heard in federal court in Portland. The judge there had refused to enter a restraining order to go into effect until the suits were settled.
Those four suits questioned the measure based on the U.S. Constitution. The suit in Harney County questioned it based on the Oregon Constitution.
