Man arrested for firearms violations

PENDLETON – The following is a news release from Pendleton Police Chief Chuck Byram:

June 20, 2021 at 7:11 p.m., Pendleton Police Department officers responded to the area of the 1000 block of SE Court Place after receiving a 911 report from a neighborhood resident that a male, sitting in a black Honda sedan, was waving a rifle at people. The 911 caller identified the suspect as 37-year-old Pendleton resident Scott Luis Hernandez. Officers with the Pendleton Police Department are familiar with Hernandez and know him to be prohibited from possessing firearms.

Upon arrival in the area, officers observed Hernandez in his vehicle and he displayed the “upper” (barrel and foregrip) of an AR15 style rifle to the officers. Hernandez ultimately placed the “upper” of the rifle on the hood of his vehicle. Officers gave commands for Hernandez to exit the vehicle, but he refused to comply. As officers attempted to take physical control of Hernandez, he resisted.

Officers noticed at that time that Hernandez had a handgun in his waistband/right hip area. Officers were only able to see the handgun due to Hernandez’ shirt being pulled up during the struggle to take him into custody. One officer was able to remove the handgun from the waistband of Hernandez during the struggle.

A taser was deployed, but was ineffective against Hernandez. Hernandez was ultimately placed into custody and evaluated by medics prior to transport to the Umatilla County Jail. Drug and alcohol use by Hernandez were likely a factor in this case. Hernandez was lodged at the Umatilla County Jail on the following charges:

  • Felon in Possession of a Weapon
  • Unlawful Possession of a Firearm
  • Interfere with a Peace Officer
  • Resisting Arrest
  • Disorderly Conduct II

This case will be referred to the Umatilla County District Attorney’s Office for prosecution.
